Welcome to our PonexMind platform (hereinafter referred to as 'Platform'). By using the tools provided through this platform (text generation, image/video creation, SEO tools, logo design, etc.), you are legally deemed to have accepted the Terms of Service stated below.

If you do not accept any of these conditions, please stop using the Platform and our services.

1. Account Registration and Security

Age Limit: To use the Platform, you must be at least 18 years old (or have reached the legal age of majority in your country of residence).

Accurate Information: It is your responsibility that the information you provide during registration is accurate, complete, and up to date.

Account Security: Maintaining the confidentiality of your account password is your responsibility. You are held directly responsible for all activities under your account. You must contact us immediately when you notice a suspicious situation.

2. Provided Services and AI Outputs

System Inputs: You guarantee that you hold the legal rights or have obtained the necessary permissions for the text, image, video, or other data (inputs) you enter to run the AI tools on the Platform.

Ownership of Generated Content (Copyright): The rights to the outputs (articles, logos, images, etc.) generated for you by the AI tools on the Platform belong to you (the user) to the extent permitted by applicable laws. You may use this content for commercial or personal purposes.

Similar Outputs: Due to the nature of artificial intelligence, it is possible for different users to receive similar or identical outputs as a result of giving similar inputs (prompts). The Platform does not grant you a right or monopoly over similar outputs generated for another user.

3. Acceptable Use and Restrictions

You undertake to comply with the following rules while using our platform. You cannot use our services to:

Generate or upload content that is illegal, threatening, insulting, pornographic, obscene, or constitutes a copyright infringement.

Provide inputs that will infringe the intellectual property rights, trade secrets, or privacy rights of others.

Engage in activities that will harm the infrastructure of the Platform, bring an excessive load (DDOS, etc.), or manipulate the system via automated bots/spiders (scraping/reverse engineering).

Use our AI models to train or copy your own AI models (by data collection method).

Engage in fraudulent behavior aimed at exceeding the API and system limits offered by the Platform.

4. Pricing, Payments and Renewals

Subscription and Packages: Some features on the Platform are priced as monthly/yearly subscriptions or one-time credit packages. Current prices are published on our website.

Automatic Renewal: Purchased subscriptions automatically renew over your registered payment method at the end of the billing period (unless canceled).

Price Changes: The Platform reserves the right to change service prices at any time. Price changes become effective from the new billing period and are notified to users in advance.

Refund: The provisions of the Refund and Cancellation Policy apply to refund processes.

5. Limitation of Liability and Disclaimer of Warranty

'As Is' Basis: Our platform and AI tools are provided on an 'as is' and 'as available' basis. Since AI outputs are generated algorithmically, we make no warranties regarding the accuracy, completeness, commercial suitability, or fitness for a particular purpose of the outputs.

Disclaimer: Our platform can in no way be held responsible for incorrect information generated by the AI, system interruptions, data losses, or registration problems that may be experienced in the commercial branding process of the generated logos/designs.

Third-Party APIs: The Platform may use the infrastructures of third-party AI providers (OpenAI, Google, etc.) to generate outputs. Our platform is not responsible for disruptions that may occur in the service due to global outages or rule changes originating from these providers.

6. Suspension and Termination of Service

In the event that a violation of the Terms of Service or legal regulations is detected, our platform has the right to, without prior notice:

Temporarily or permanently suspend the user's account,

Completely block access to the Platform.

In case of violation, no refund will be made for remaining credits or subscription fees in the account.

7. Changes

We reserve the right to update these Terms of Service from time to time. The changes made take effect from the moment they are published on our website. Your continued use of the platform after the changes means you accept the new conditions.
