Welcome to the PonexMind platform (hereinafter referred to as the 'Platform'). By using the tools provided through this platform (text generation, image/video creation, SEO tools, logo design, etc.), you are deemed to have legally accepted the Terms of Service specified below.

If you do not accept any of these terms, please stop using the Platform and our services.

1. Account Registration and Security

Age Limit: You must be at least 18 years old (or have reached the legal age of majority in your country of residence) to use the Platform.

Accurate Information: It is your responsibility to ensure that the information you provide during registration is accurate, complete and up to date.

Account Security: It is your responsibility to keep your account password confidential. You are directly responsible for all activities under your account. You should contact us immediately if you notice any suspicious activity.

2. Services Provided and AI Outputs

System Inputs: You warrant that you own the legal rights to, or have obtained the necessary permissions for, the text, image, video or other data (inputs) you enter to run the AI tools on the Platform.

Ownership of Generated Content (Copyright): The rights to the outputs (articles, logos, images, etc.) generated for you by the AI tools on the Platform belong to you (the user) to the extent permitted by applicable law. You may use this content for commercial or personal purposes.

Similar Outputs: Due to the nature of AI, it is possible for similar or identical outputs to be generated when different users provide similar inputs (prompts). The Platform does not grant you any right or exclusivity over similar outputs generated for another user.

3. Acceptable Use and Prohibitions

You agree to comply with the following rules when using our Platform. You may not use our services for the following purposes:

Creating or uploading content that is illegal, threatening, defamatory, pornographic, obscene or infringes copyright.

Providing inputs that would violate the intellectual property rights, trade secrets or privacy rights of others.

Engaging in activities that would damage the Platform's infrastructure, overload it (DDOS, etc.) or manipulate the system through automated bots/spiders (scraping/reverse engineering).

Using our AI models for the purpose of training or copying your own AI models (via data collection methods).

Engaging in fraudulent behavior aimed at exceeding the API and system limits offered by the Platform.

4. Pricing, Payments and Renewals

Subscriptions and Packages: Some features on the Platform are charged as monthly/annual subscriptions or one-time credit packages. Current prices are published on our website.

Auto-Renewal: Purchased subscriptions are automatically renewed through your registered payment method at the end of the billing period (unless cancelled).

Price Changes: The Platform reserves the right to change service prices at any time. Price changes take effect from the next billing period and users are notified in advance.

Refunds: The provisions of the Refund and Cancellation Policy apply to refund processes.

5. Limitation of Liability and Disclaimer of Warranty

'As Is' Basis: Our Platform and AI tools are provided on an 'as is' and 'as available' basis. Since AI outputs are generated algorithmically, we make no warranty as to the accuracy, completeness, merchantability or fitness for a particular purpose of the outputs.

Disclaimer: Our platform cannot be held responsible in any way for incorrect information generated by AI, system interruptions, data loss, or registration issues that may arise during the trademark registration process of generated logos/designs.

Third-Party APIs: The Platform may use the infrastructure of third-party AI providers (OpenAI, Google, etc.) to generate output. Our platform is not responsible for any disruptions in service caused by global outages or rule changes originating from these providers.

6. Suspension and Termination of Service

If it is determined that the Terms of Service or applicable law has been violated, our platform has the right, without prior notice, to:

Temporarily or permanently suspend the user's account,

Completely block access to the Platform.

In the event of a violation, no refund will be made for remaining credits or subscription fees on the account.

7. Changes

We reserve the right to update these Terms of Service from time to time. Changes take effect as soon as they are published on our website. Continuing to use the Platform after the changes means you accept the new terms.
